Spain has joined ultra-progressive globalist strongholds like California in penalizing parents who oppose gender transition ‘treatments’ for their children.

On June 25, 2025, a controversial amendment to the Spanish Penal Code introduced up to two years of imprisonment for parents, doctors, psychologists, or educators who resist so-called “affirmative therapies” for minors.

The 2025 amendment expands Spain’s 2023 “Trans Law,” which sought “real and effective equality for trans people.” The earlier law allowed those 16 and older to change their legal gender without medical or parental oversight. Those aged 14–16 needed parental consent, while 12–14 required judicial approval.

It also banned conversion therapy, blocking parents from seeking alternative psychological treatments for gender dysphoria.

California’s AB 957 (2023) requires courts to consider a parent’s support for a child’s gender identity in custody disputes, often splitting families. In contrast, Spain’s amendment imposes harsher penalties by threatening jail time for those prioritizing their child’s well-being over ideological conformity.

Critics warn that the law empowers predatory elements in the medical and therapeutic fields and undermines parental authority.

Doctors and psychologists risk legal consequences for urging caution with irreversible procedures on minors, creating a chilling effect on professional practice.

The Spanish Congress of Deputies passed this measure with a strong majority of 311 votes in favor and 33 against. The nationalist Vox party was the only parliamentary opposition, joined by a single abstention from the Navarrese People’s Union (UPN).

The center-right Popular Party (PP), despite prior pledges to oppose radical gender laws, supported the bill. This move sparked condemnations of betrayal from conservative voters and feminist groups, who call the law a dangerous overreach.

Unlike the UK and Sweden, which have restricted gender transition treatments for minors due to limited evidence of long-term safety and effectiveness, Spain has taken a different route.

Its Socialist-led government, supported by far-left and separatist groups, has doubled down on policies that many voters argue prioritize ideological agendas over science.
